When it all boils down, . . . Here's what's left, . . .


Let me start with, . . . Well, let's pause just a second, to remember what Patrick Fitzgerald, the special prosecutor, was supposed to investigate.

His job was to find out whether or not the identification of Valerie Plame was a violation of federal law. The answer to that question is apparently a firm, “No!”

Sure, Fitzgerald is keeping the investigation open for a time, but it's a save bet to assume that the identification of Plame was not a crime, either because she was not a covert CIA agent at the time the identification was made, or because the person making the identification was not aware of her status. The evidence seems to be that she was not covert at the time she was identified. No crime.

What crime has been charged?? Scooter Libby, Vice President Cheney's Chief of Staff, has been charged with one count of obstruction of justice, two counts of perjury and two counts of making false statements.

What did he do?? Well, as best as I can figure it out it happened this way: New York Times reporter Matthew Cooper asked Libby what he had heard about the status of Valerie Plame. Libby answered that he had heard other reporters saying that Plame worked for the CIA. The investigation apparently showed that Libby told Cooper that Plame worked for the CIA without the qualification that he had heard that from other reporters. There's two of your crimes, the two counts of perjury. Libby also said that he had talked to NBC's Tim Russert about the affair, when he had not.

What wasn't Libby charged with?? Disclosing the name of a CIA covert agent, or conspiring to do so. I don't know who first coined this phrase, but essentially Libby was charged with lying about a crime that was not committed.

Now, . . . let's talk about the lying thing. Our entire system of justice relies of our ability to compel people to tell the truth and to punish them if they should fail to do so. Lying under oath is a serious matter, whether you're lying to deny a young woman you've sexually harassed her day in court, or lying to protect your political position or the position of your boss. These lies must be punished, not necessarily because of the severity of the crime involved, but because of the fact that someone swore to tell the truth, and then did not. The severity of the crime being investigated is not the issue, the fact that a lie was told is. Our system of civil and criminal justice would fall into ruin if we were to adopt some standard that outright perjury or lying to investigators can be tolerated if the crime being investigated isn't all that serious. We would then have to create some system under which we would grade civil and criminal complaints as to their degrees of seriousness so as to determine whether the people involved would have to tell the truth or not.

In the case of Scooter Libby and Valerie Plame it seems clear that no crime was committed, yet lies may have been told during the investigative process that made that determination. If so, then indictments are proper, and punishment is warranted. Remember, though, that it is not enough for a statement to be untrue for it to be categorized as a lie. The person uttering that statement has to know that the statement was not true at the time the statement was made.

Therefore, George Bush's assertions that Saddam Hussein had weapons of mass destruction was not a lie, unless it can be proven that Bush knew at the time he made the statement that it was not true. (Since such weapons have, in fact, been found ... the question of whether or not Bush lied has been put to rest.)

Now that the media circus is close to being played out, let's review:

1.) The left and the media are trying to portray this as some sort of confirmation that 'Bush lied' about weapons of mass destruction. Libby's indictment is nothing of the sort. In fact, Libby was indicted for the cover-up of a non-crime. Fitzgerald went out of his way, during the Press Conference he held on Friday, to say Libby wasn't being charged for outing Valerie Plame. Thus, the entire reason for the initial probe has been dropped.

2.) Liberals are acting like Scooter Libby is the most powerful government official to have ever lived. The fact of the matter is that most people have no idea who Scooter Libby is. For all they know, it's Phil Rizzuto's love child from his playing days and not the vice-president's chief of staff. The story will be off the radar screen by this afternoon, once Bush nominates his new Supreme Court replacement, and the media circus on that topic begins.

3.) This is not the start of some huge scandal. Fitzgerald had 2 years and millions of dollars to investigate this non-crime, and we have one person being charged. Case closed. If it was going to go any higher, it would have already.

Democrats are naturally disappointed, but that won’t keep them from kicking and screaming, . . . that’s just their nature, . . . to bleed all they can bleed, for the cameras and blog commentary postings. Poor, poor, li’l ol’ me – I’ve been wronged by the terrible, corrupt Bush administration. Flinging it against the wall, just to see if it sticks. Sorry Bob!! Sorry Tim!! Sorry Cindy!! It won’t stick.

Oh, . . . and to further enrage your liberal friends, . . . tell them that Libby's lying to the grand jury is absolutely no different than Bill Clinton's. The only valid comparison is the fact that Bill Clinton didn't serve a day in jail, and Scooter Libby almost certainly will, . . . Then say, in a whisper, . . "(Unless he’s pardoned upon arrival)"

Is this the recovering drug junkie Limbaugh story you wanted us to read? For being an ex-law enforcement guy and currently a PI I would have thought you would realize what's going on. You really know how to twist and sugar-coat this indictment. If Libby is found guilty of the charges against him, then he obviously was covering something up. One would think that it would be extremely difficult for Fitzgerald to find out if Karl and anybody else did something wrong if Libby is kicking sand in Fitzgeralds face. RIGHT Mr. ex-Law-Enforcement official, purveyor of truth and justice?? You think it's OK to lie. Now Scooter is probably going to defend himself by saying
"Don't Remember", how convenient.

He'd like to be, just as you and I would like to be, but, . . . sadly, we're not, either. Do you really want to go there?? . . . or didja think I was just too dumb to be able to notice your hypocracy?? Doesn't it bother you, when you're wrong about EVERYTHING??

You're absolutely correct that if he KNEW he was lying, then he's in deep do-do, . . I think I said that! Maybe you just can't get rid of the liberal bliners long enough to comprehend it, . . . or, you weren't reading far enough before you choked on so much truth, all at the same time. Either way, you seem to have missed that point.

Well, let me say "thanks" for impugning me and my profession to the extent to show your own ignorance. You did a really nice job. You see, Bob -- one who deals with these kinds of things daily for over thirty seven years, tends to teach you ALL the steps necessary in our criminal justice system, and you don't make final judgments until all steps have played out, completely. However, one gets fairly used to making preliminary judgments on matters of a political nature, and it's pretty easy to sort the wheat from the chaff, and see right through people like Fitzgerald, and the motives and conditions that drive him.

"I don't remember," is a very valid answer to any question, asked in a courtroom, if you truly don't remember. It's the exact reason tthat Hillary CLinton wasn't indicted for hiding, (or misplacing), the Rose Law Firm Records. But it's much different than the answer, "I don't know," which is also a very valid answer in a courtroom, if the question is one that the witness truly doesn't know the answer for, . . . but I'm sure that's far too complex for you to understand.

Care to make a wager, on whether Mr. Fitzgerald wins his criminal case against Mr. Libby, and obtains results that lead to actual jail time for the defendant?? I'll make it very easy on you -- if you win, I'll close down the VRWC Blog, and if I win, you never post to another conservative website, ever again, as long as you live.

This indictment is such a politically charged bunch of bullshit, directed at a man who provided the evidence against himself, and then testified otherwise.

Gee, most any moron practicing in the legal profession can easily determine that there's no way, on the face of it, to prove that he intended to deceive his questioners?? (don't worry, I don't expect you to be able to live up to that standard).

I'm not sure there's enough substance to get this into a courtroom, for more than about five minutes, before the magistrate throws Fitzgerald out, on his ear.

Our courts are getting a bit upset with the folks over at Howard Dean's office, and the like, and I expect there will be some reprisals, coming soon. Your mileage may vary!

That's like someone saying:

"I was raised by a good heterosexual who taught me to be a good christian, but did so, with entirely homosexual ideals."

It's twisted logic, doesn't make sense. Now don't get rediculous and think I'm calling you gay. It's just an example. I know you're not gay!! Yes, your analogies are a bit on the sick side, my liberal friend. And, anyone would be offended by that kind of comparison. Postal is NEVER out of the question, and unless you have balls as big as a Cadillac, and the muscle to back it up, a word to the wise is never to think that anonymous is really safe mode.

Remember what I do for a living, Bob; and that the internet was designed with tracking devices all over the place. I'm not all that interested YET, (because no one would be paying me, it takes some level of time and effort, and I'm a capitalist of the first degree), but that could change if you want to be friskie enough with your verbalizations and your poison pen. I've tried to be nice, and I've tried to be civil, but you want to bring your name-calling, insulting sexual innuendo, and racism into it, as well as your admission that you've shown some rather unnatural interest in my profile; so I'd have to say that you've been adequately warned about the possiblities, and the ball is in your court, so to speak.

Even though the U.S. Constitution contains NOTHING related to a "Right of Privacy," as a good conservative I think there is definately a God-Given Right of Privacy, and I'd like to exercise it, from time to time. I'm sure you'd disagree, and tell me that the government has assigned such a right, but that's the difference between us. And, . . . you, in your elitist attitude don't mind for a moment, violating my rights of privacy, no matter their origin. Such liberal audacity!!

As I said before, it seems your interest in my profile has taken a turn toward the unnatural, . . . NOYB would be my answer to your question.

Maybe you'd like to tell me the answers to all the unnatural questions I could ask about YOUR personal life. Or, . . . to make a more valid comparison, . . . I could ask something semi-public, . . for example, "When did you stop beating your wife??"

I can appreciate what your saying. Our opinions, philosophies are partially influenced by events that have taken place our lives. I surmise you don't want to discuss this notation you made awhile back:

Oh, My God! A person who is a true Gentleman and a Scholar. And
his Gentlemanly Attitude must surely be exceeded only by his Scholarly
Aptitude.

I try to adhere to the same standards. I have a real and honest
dislike for people who would tear my county apart with Liberal ideas and ideals
which are the building blocks that I saw my fellow baby-boomers adhereing to in
the 1960s, after I got out of HS. When I got back from SE Asia, I went back to
school, and was spit upon and called "baby-killer" by these same kind of
assholes. Now that I've adhered to my principals and am in the latter years of
my life, I know, now more than ever, that I was a lot more right than they
were. Sure I made mistakes and I had hard times. I've not been the most
perfect parent, and there are other parts of my life that I'm not the proudest
about, but I never abandoned my conservative principals and never will. My
dislike has bordered upon hatred a few times and I'm not too proud of that, but
I persevere.

Don't ever let go, Jon. Let the assholes find another place to live
and leave us to our ideals. I certainly won't miss their sorry asses, should
a miracle occur and they would actually leave.
